1. About these terms
These Terms of Use govern your use of Hootdoku, its online features and this website, which are provided by Owl Media and Design, LLC (“we,” “us,” or “our”). By using Hootdoku after these terms take effect, you agree to them. If you don’t agree, please don’t use it.
Our Privacy Policy explains how personal information is handled. Agreeing to these terms is not a substitute for any separate consent needed for advertising, tracking or other optional processing.
2. Eligibility and accounts
Hootdoku is a general-audience game. It is not directed at children under 13.
You must be legally able to agree to these terms. If you are under the age at which you can agree to them where you live, a parent or legal guardian must review and agree to them for you, and approve any purchases.
Hootdoku creates a guest account the first time you open it. A guest account belongs to one device: if you lose the device, your progress may be lost with it. You can use Sign in with Apple to back up your progress and use it on another device. Please keep your device secure and don’t use someone else’s account without permission. Apple’s sign-in service is also subject to Apple’s terms.
Your display name can appear on leaderboards. Don’t use a name that is offensive, impersonates someone, or infringes anyone’s rights. We may change or remove a name that does.
3. Permission to play
We give you a limited, personal, non-exclusive, non-transferable permission to use Hootdoku for lawful, non-commercial entertainment, subject to these terms and the App Store’s rules. This permission doesn’t transfer ownership of the game or its content.
The game’s software, puzzles, artwork, owls, interface, branding and other content belong to us or our licensors and are protected by intellectual-property laws.
4. Fair play
Don’t use Hootdoku to break the law, infringe anyone’s rights, or interfere with other players. Don’t cheat on leaderboards, for example by using automated solvers, modified apps or faked results; don’t exploit bugs to get purchases or rewards; and don’t bypass access or payment controls or disrupt the service. We may remove results that we reasonably believe were not achieved fairly.
Don’t copy, redistribute, reverse engineer or modify the software, or copy our puzzles in bulk, except where we allow it or the law gives you a right we can’t restrict.
5. Purchases
Purchases are made through Apple’s App Store with your Apple Account, at the price shown before you confirm, plus any taxes Apple applies. Apple processes the payment; we never receive your card details. RevenueCat helps us confirm purchases and keep track of what you have bought.
Hootdoku Premium is a one-time purchase. It is not a subscription and nothing renews. At the time of these terms it unlocks the five Premium groves and their 200 levels, 20 more owls to discover, unlimited hints, all ten themes, free second chances when you run out of hearts, and removes ads.
What “forever” means: when we describe Premium as a one-time purchase, as “forever” or as “lifetime”, we mean for as long as we offer and support Hootdoku. It doesn’t mean your lifetime, your device’s lifetime or a fixed number of years, and it isn’t a promise that the game or its online services will run forever. Premium doesn’t expire, and we won’t turn it into a subscription or move features that were part of Premium when you bought it behind a new paywall for you. We may add new things later that are sold separately.
Restoring: Premium belongs to the Apple Account that bought it. You can restore it at no cost with Restore Purchases in the app’s Settings for as long as Hootdoku is available on the App Store.
Refunds are handled by Apple under Apple’s policies; you can ask for one at reportaproblem.apple.com. Except where the law gives you a right we cannot exclude, purchases are final. If Apple refunds a purchase, we may remove what it unlocked. These terms don’t take away any mandatory refund, withdrawal or consumer rights you have.
We may change prices and what is offered for sale. Changes won’t reduce what a purchase you have already made gives you, except as described in section 8.
6. Hints, hearts and other in-game items
Hints, hearts, stars, owls, themes and other in-game items are virtual items. We give you a limited, personal, non-transferable licence to use them inside Hootdoku. They have no cash value and can’t be sold, traded, transferred to another account or exchanged for money, unless the law requires otherwise.
Some items are earned rather than sold and are given when you meet the condition shown in the game. We may correct errors, and remove rewards or leaderboard results obtained through cheating or abuse. Any change affecting paid content remains subject to consumer protections and the terms presented when you bought it.
7. Ads and third-party services
The free version of Hootdoku shows ads provided by Google AdMob. Full-screen ads can appear when you move on to the next level. Rewarded videos are optional: you can choose to watch one for a free hint or to get a heart back. Players with Hootdoku Premium are not shown ads.
Hootdoku also uses Sign in with Apple, RevenueCat and Meta’s SDK, which measures how our advertising on Facebook and Instagram performs. Our Privacy Policy describes their roles and your choices.
Ads and links may lead to third-party products or websites with their own terms and privacy policies. An ad is not an endorsement by us. To the extent the law allows, we aren’t responsible for third-party products, but this doesn’t exclude any responsibility we cannot lawfully limit.
8. Updates, availability and progress
We may update the game, change features, carry out maintenance, or discontinue parts of the service. Online features such as the Daily Grove ranking, leaderboards and sync need an internet connection and our servers. We will give notice and remedies for material changes where the law requires.
Progress is saved on your device and, when you are online, synced to your account. Losing a device, using a different account, or deleting your account can affect what progress is available. We can’t guarantee uninterrupted operation or the recovery of every saved item, without limiting any legal obligation we have.
9. Ending use and account restrictions
You may stop using Hootdoku at any time. You can delete your account from Settings → Account in the app. Deletion is permanent: your online profile, synced progress and leaderboard times are erased and can’t be restored. Hootdoku Premium belongs to your Apple Account, so you can restore it afterwards.
We may restrict or suspend access when reasonably necessary to deal with a serious breach of these terms, cheating, fraud, security risks, unlawful activity or a legal requirement. Where appropriate and required by law, we will explain why and give you a chance to resolve the issue.
10. Limits and your legal rights
We work hard to make Hootdoku enjoyable and reliable, but we can’t promise it will always be available, error-free or compatible with every device. To the extent the law allows, the service is provided “as available” and we exclude warranties that are not expressly stated here.
To the extent the law allows, we aren’t responsible for losses that were not reasonably foreseeable, losses caused by misuse, or business losses arising from personal entertainment use. Nothing in these terms excludes or limits liability for fraud, intentional misconduct, or any other liability that can’t lawfully be excluded. Your mandatory consumer rights, including remedies for faulty digital content, are unaffected.
11. Questions and disputes
Please contact us first so we can try to sort out any concern. These terms don’t require mandatory arbitration or a class-action waiver.
These terms are governed by the laws of Texas, United States, except where mandatory law provides otherwise. If you are a consumer elsewhere, you keep the non-waivable protections of the laws that apply to you, including any right to bring a claim in your local courts.
12. Changes to these terms
We may revise these terms when the game or the law changes. We will update the date at the top and give additional notice of material changes where required. Changes won’t take away rights you have already gained, and we will ask you to agree again where the law requires.
If any part of these terms is found unenforceable, the rest continues to apply as far as the law allows. Not enforcing a provision once doesn’t waive our right to enforce it later.
